Welcome to VibeGuide. These Terms of Service govern your access to and use of the VibeGuide mobile application, website, booking system, experiences, services, and related features. By creating an account, accessing, or using VibeGuide, you agree to comply with and be legally bound by these Terms. If you do not agree, please do not use the Platform.

1. Company Information

VibeGuide is operated by VİBECORE TURİZM SEYAHAT ACENTASI VE DİJİTAL HİZMETLER TİCARET LİMİTED ŞİRKETİ.

2. About VibeGuide

VibeGuide is a digital travel and experience platform that connects travellers with licensed local guides, curated experiences, and tourism-related services.

  • Historical and cultural experiences
  • Museum experiences
  • Food and beverage tours
  • Local activities
  • Custom tourism experiences

VibeGuide acts as a technology provider, booking facilitator, marketplace platform, and intermediary service. Unless explicitly stated otherwise, VibeGuide does not directly provide guiding services. Guides operate as independent service providers. Where required under Turkish law, guides must hold a valid kokart issued by the Ministry of Culture and Tourism.

3. Eligibility

You must be at least 18 years old to create an account, make bookings, or use paid services. By using VibeGuide, you confirm that you are legally capable of entering agreements, all information you provide is accurate, you will comply with applicable laws, and you will use the Platform lawfully. Travellers under 18 may participate only under the supervision and responsibility of a parent or legal guardian. Guides may be required to complete identity verification and professional verification before becoming active on the Platform.

4. User Accounts

Certain Platform features require account registration. Users are responsible for maintaining account security, protecting login credentials, updating account information, and all activity conducted under their accounts. Tourists may be required to verify their email address before booking. VibeGuide may suspend, restrict, or terminate accounts that violate these Terms, create safety risks, engage in fraud, abuse refunds or payments, misuse the Platform, harass others, or damage platform integrity.

5. Experience Types

VibeNow (Instant Experiences)

VibeNow allows travellers to request available guides for near-immediate experiences based on operational availability. Confirmation depends on guide availability, operational conditions, location, timing, and safety considerations.

VibeSquad (Shared Group Experiences)

VibeSquad allows travellers to join or create shared group experiences. Bookings may depend on minimum participant requirements, payment authorization, guide availability, and final operational confirmation. In VibeSquad experiences, participants may see each other's first name and profile photo.

Private Tours (Planned Reservations)

Private tours allow travellers to reserve experiences for selected dates, times, languages, group sizes, and preferences, subject to guide availability and operational approval.

6. Bookings and Reservations

Bookings submitted through VibeGuide are considered requests until officially confirmed through the Platform. Users agree to provide accurate booking information, arrive on time, follow meeting instructions, behave respectfully, and comply with local laws and safety instructions. VibeGuide reserves the right to refuse, modify, limit, reschedule, or cancel bookings where reasonably necessary for safety, fraud prevention, operational limitations, legal compliance, or force majeure events.

7. Prices and Payments

Prices shown on VibeGuide may include guide fees, platform fees, VAT where applicable, operational charges, and booking-related fees. All payments are processed through third-party payment providers. By making a booking, users authorize VibeGuide and its payment providers to process payments related to Platform services. VibeGuide does not directly store full credit card information unless explicitly stated. Currency exchange fees, international transaction fees, or banking fees may apply depending on the user's financial institution.

8. Payment Authorization

For certain booking types, especially VibeSquad experiences, VibeGuide or its payment provider may place a temporary authorization hold on a payment method before final booking confirmation. If the booking is confirmed, the authorized amount may be captured. If the booking is not confirmed, the authorization may be released automatically. Release timing depends on banks and payment providers and may take several business days.

9. Cancellations and Refunds

Cancellations and refunds are governed by the Cancellation & Refund Policy shown during booking and the booking-specific conditions presented before checkout. Refund eligibility depends on booking type, cancellation timing, experience category, guide assignment status, operational conditions, weather, force majeure events, and applicable law.

Guide cancellations may result in full refunds, support compensation, booking credits, or guide suspension for repeated violations. VibeGuide reserves the right to investigate suspicious refund activity, abuse, or fraudulent claims.

10. No-Show and Late Arrival

If a traveller fails to attend a confirmed booking without proper cancellation, refunds may not be available. Late arrival may result in shortened experiences, modified routes, cancellation, or partial service completion depending on operational feasibility. No-show disputes may be reviewed using booking records, timestamps, location signals, in-app communications, and submitted evidence.

11. Travel Activity Risk

Experiences listed on VibeGuide may involve walking, transportation, outdoor environments, crowded locations, food consumption, physical activity, weather exposure, and travel-related risks. By participating, travellers voluntarily accept these inherent travel risks. Travellers are responsible for ensuring experiences are suitable for their physical condition, mobility, dietary needs, health circumstances, and fitness level. VibeGuide is not responsible for injuries, illness, theft, delays, transportation disruptions, weather interruptions, or losses reasonably associated with travel activities, except where liability cannot legally be excluded.

12. Emergency Situations

In emergencies, travellers should contact local emergency authorities immediately. VibeGuide is not an emergency-response provider and cannot guarantee immediate intervention, rescue services, or on-site emergency assistance.

13. Traveller Responsibilities

  • Respecting local laws
  • Respecting cultural and religious locations
  • Following guide instructions
  • Managing personal belongings
  • Obtaining visas and travel documents
  • Maintaining appropriate travel insurance where desired
  • Informing guides about accessibility or dietary requirements in advance
  • Paying third-party costs clearly identified within the booking (museum tickets, transportation fees, optional entrance fees)

14. Guide Responsibilities

  • Maintaining accurate profile information
  • Complying with tourism regulations
  • Holding valid licenses where required
  • Delivering confirmed services professionally
  • Arriving at meeting points on time
  • Behaving respectfully toward travellers
  • Maintaining applicable insurance obligations
  • Avoiding off-platform transactions

15. Independent Service Providers

Guides operate as independent service providers. Nothing in these Terms creates employment, partnership, agency, franchise, joint venture, or employer-employee relationship between VibeGuide and guides. Guides are solely responsible for taxes, permits, invoices, insurance, professional compliance, and legal obligations.

16. Off-Platform Transactions

Travellers and guides may not bypass the Platform for the purpose of avoiding fees, commissions, or policies, moving bookings outside VibeGuide, or exchanging payment information for off-platform transactions. Violations may result in booking cancellation, forfeiture of pending payments, account suspension, or permanent platform removal.

17. User Conduct and Community Standards

Users agree not to harass others, discriminate, threaten users, upload illegal content, engage in fraud, abuse reviews, manipulate bookings, interfere with Platform operations, damage cultural or historical sites, or endanger guides, travellers, or communities. VibeGuide does not tolerate hate speech, racism, sexism, religious discrimination, LGBTQ+ discrimination, violence, sexual misconduct, unsafe behaviour, or exploitation of local communities.

18. Reporting and Safety Tools

Users may report unsafe conduct, harassment, fraud, illegal activity, misleading listings, or violations of these Terms through official support channels or in-app reporting systems. VibeGuide may investigate reports and take moderation actions including warnings, content removal, booking cancellation, temporary suspension, permanent removal, or platform restrictions.

19. Platform Communications and Monitoring

VibeGuide may review, moderate, retain, or investigate in-app communications, booking activity, uploaded content, safety reports, payment disputes, account activity, and platform metadata for purposes including customer support, fraud prevention, trust and safety, dispute resolution, legal compliance, payment investigations, and platform integrity. Such processing is conducted in accordance with the Privacy Policy and applicable data protection laws.

20. Reviews, Ratings and User Content

Users may submit reviews, comments, photos, and other content related to genuine experiences. Fake, misleading, retaliatory, or abusive reviews may be removed. By submitting content, users grant VibeGuide a worldwide, non-exclusive, royalty-free license to use, display, reproduce, adapt, distribute, and promote such content for Platform operations, trust and safety, and marketing purposes. Users may not upload content that is illegal, defamatory, infringing, misleading, harmful, abusive, sexually explicit, or discriminatory.

21. Intellectual Property

All VibeGuide branding, software, design, content, logos, graphics, interfaces, and Platform materials belong to VibeGuide or its licensors. Users may not reproduce, copy, scrape, decompile, distribute, commercially exploit, or build competing services from Platform materials without written permission.

22. Privacy and Data Protection

By using VibeGuide, users acknowledge that personal data may be processed in accordance with the Privacy Policy and applicable privacy regulations, including KVKK and, where applicable, GDPR. Users are responsible for ensuring submitted information is accurate and lawful.

23. Electronic Communications

By using VibeGuide, users consent to receive communications related to bookings, support, refunds, cancellations, account activity, legal notices, safety alerts, and service updates through email, SMS, push notifications, and in-app messaging.

24. Third-Party Platforms and Services

The VibeGuide application may be distributed through platforms including Apple App Store and Google Play. Apple, Google, and other platform providers are not responsible for bookings, refunds, guide conduct, operational issues, customer support, or claims related to Platform use. VibeGuide may also integrate third-party services including payment providers, maps, analytics systems, communication tools, and authentication providers. VibeGuide is not responsible for interruptions caused by third-party systems outside reasonable control.

25. Platform Availability

VibeGuide aims to provide reliable services but does not guarantee uninterrupted Platform availability. The Platform may experience maintenance, outages, technical failures, delays, security interruptions, or third-party service failures. Features may be updated, modified, or discontinued without prior notice.

26. Force Majeure

VibeGuide is not liable for delays, cancellations, or interruptions caused by events beyond reasonable control, including natural disasters, earthquakes, severe weather, transportation disruptions, pandemics, political unrest, government actions, terrorism warnings, internet outages, or payment-provider failures.

27. Limitation of Liability

To the maximum extent permitted by law, VibeGuide shall not be liable for indirect damages, incidental damages, lost profits, missed transportation, personal disputes, third-party actions, guide conduct, travel disruptions, lost belongings, data loss, or force majeure events. Nothing in these Terms excludes liability that cannot legally be excluded under applicable law. Where permitted by law, VibeGuide's total aggregate liability shall not exceed the amount paid for the affected booking.

28. Indemnification

Users agree to indemnify and hold harmless VibeGuide, its affiliates, officers, employees, contractors, and partners from claims, damages, liabilities, losses, or expenses arising from misuse of the Platform, unlawful activity, disputes with other users, fraudulent conduct, violation of these Terms, or violation of third-party rights.

29. Suspension and Termination

VibeGuide may suspend or terminate access where users violate these Terms, engage in fraud, threaten safety, abuse refunds, attempt off-platform transactions, or create legal or operational risks. Serious violations may result in immediate suspension without prior notice.

30. Account Deletion and Data Requests

Users may request account deletion through the in-app delete function, through official support channels, or through designated deletion forms where available. After deletion, certain records may be retained where legally required for fraud prevention, tax obligations, dispute resolution, accounting, or regulatory compliance. Deletion requests are handled in accordance with applicable privacy laws.

31. Changes to These Terms

VibeGuide may update these Terms periodically. Updated versions become effective upon publication on the Platform. Material changes may be communicated through in-app notifications, email, or Platform announcements. Continued use of the Platform after updates constitutes acceptance of revised Terms.

32. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Türkiye unless mandatory consumer protection laws require otherwise. Disputes shall be resolved before the competent courts and enforcement offices of Muğla, without prejudice to mandatory consumer rights applicable in the user's country of residence.

33. Entire Agreement

These Terms, together with the Privacy Policy, Cancellation Policy, and related Platform policies, constitute the complete agreement between users and VibeGuide regarding Platform use.
